Old Waters Inn at Wedowee Cancellation Policy: All guests will pay for their first night stay upon booking a reservation. 24 hours prior to guest's stay, the credit card on file will be charged for their entire reservation. Guests may cancel their reservation by 11:00 AM Central Time the day before their reservation date. To cancel please call 256-357-1081 or email us at frontdesk@oldwatersinn.com.

Terms and Conditions


1. Definitions Throughout these Terms and Conditions, the following definitions apply:


OWI: An acronym for “Old Waters Inn at Wedowee.” When used in these Terms and Conditions, OWI refers to the motel as well as its owners, managers, representatives, and employees.


Guest(s): The person(s) who made a reservation with OWI and is (are) financially responsible for paying for expenses related to staying at the OWI motel and/or utilizing its goods and services. 

2. Scope These Terms and Conditions apply for motel accommodation contracts as well as for all other supplies and services provided by OWI to the Guest(s). Unless expressly recognized in writing by OWI, alternative provisions, including those contained in the guest’s or customer’s general terms and conditions shall not be applicable. 

3. Online reservations The OWI website (www.oldwatersinn.com) enables you to check the accommodation offerings and availability at our motel and then submit an online reservation. The OWI website is not intended for use by anyone younger than eighteen (18) years of age. By using the OWI website, you warrant that you are eighteen (18) years of age or older. Upon completion of the reservation process, the OWI website will transmit an online or email confirmation of your reservation. A reservation is only valid when a reservation number has been issued. If you do not receive a reservation number once you have completed making an online reservation, contact OWI via email at frontdesk@oldwatersinn.com or call 256-357-1081 for assistance.

4. Phone and Walk-In reservations
 We encourage future guests to use our online reservation system at www.oldwatersinn.com to reserve rooms with us at any time day or night, seven days a week. However, we also allow future guests to make reservations by phone or by walking into our lobby and visiting us at the Front Desk. You may call OWI at 256-357-1081 and make a reservation by phone. Walk-In reservations can be made at the Front Desk from 7:00 AM Central Time through 6:00 PM Central Time. At the conclusion of the phone/in-person reservation process we will provide you with a reservation number to confirm your reservation. 

5. Hotel Prices The prices indicated on the OWI website for the motel rooms, products, and services we offer are subject to availability and may change without notice. Published rates for each room are based on maximum occupancy. There is no additional per-guest charge. The per-night rate remains the same regardless of whether one guest stays in the room or the maximum number of guests stays in the room. County and State Occupancy Taxes are not included in the prices indicated on the OWI website and will be added to your final invoice. As of April 2022, these occupancy taxes are set at 8% of motel room nightly rates and are assessed on a per-day basis. 

6. Payment OWI only accepts credit or debit cards for payment to secure a room at our motel. Accepted credit cards include American Express, Discover, MasterCard and Visa. All credit cards must be issued by a bank located within the United States, and payment must be made in US dollars. When making a room reservation, we will submit a charge for the first night’s rate (plus taxes) to your credit card as a deposit. The credit (or debit) card may then be used by OWI as a guarantee for future payment in the case of a no-show, cancellation or change to the reservation. Upon check-in, guests will be asked to present valid Federal or State Government-issued photo ID. The reservation must be under the name of the person checking in. Guests must also provide a credit (or debit) card in the name of the person presenting their photo ID. Upon check-out, guests will be presented with a final invoice and the balance due will be charged to the credit (or debit) card on file with OWI.  In the event of any charge reversal or change of authorization to a credit (or debit) card on file, Guests must make immediate payment in full to OWI using an alternate form of payment, in accordance with this agreement.​ 

7. Cancellations, Modifications, Late Arrivals, and No-Shows  To modify or cancel a reservation, Guests may contact OWI by phone at 256-357-1081 or by email at frontdesk@oldwatersinn.com for assistance.  Guests may cancel their reservation with OWI 24 hours prior to the check-in date for a full refund of the Guest's deposit. Cancellations made on check-in day or a no-show will result in forfeiture of the Guest's deposit. Guests who expect to be late arrivals must notify the OWI Front Desk via phone at 256-357-1081 or email at frontdesk@oldwatersinn.com to ensure they will be able to check in and obtain access to their room. Reservations with guests who have not checked in by 12:00 Midnight Central Time and who have not contacted OWI regarding late arrival will be treated as a no-show and will result in forfeiture of the Guest's deposit. 

8. Check-In, Check-Out, and Late Check-Out Check-in is 3:00 PM Central Time, and Check-out is 11:00 AM Central Time. We can accommodate early check-ins if your room is ready. In some instances, we can accommodate a late check-out. Please visit the OWI Front Desk or call 256-357-1081 to confirm whether early check-in or late check-out request can be accommodated. If you are still in the room after 11:00 AM Central Time and we have not approved a late check-out, you will be charged for another full day. 

9. Early Departure If you choose to leave OWI early, there is no penalty or fee for not staying with us for the entire time of your reservation. Please visit the Front Desk or call 256-357-1081 and inform us of your early departure so we can invoice you appropriately and prepare your room for our next guests. 

10. Travelling with Minors For the purposes of this clause “Child” or “Children” means a person or persons aged between 2 years and 17 years; “Infant” means a person under the age of 2 years, and “Adult” means a person aged 18 years or over. All ages will be determined from the date of check-in. Children and Infants may not stay in any room without an adult. Children sleep free on existing bedding, within the maximum allowed guests per room. If a roll-away/cot/sofa bed is required, additional charges will apply. 

11. Parking Parking is free for OWI guests. All vehicle(s) must be listed on the registration at check-in. All vehicles are parked at the risk of the owner; there is ample parking for vehicles as well as trucks with trailers. If you are traveling with a large trailer, please contact the motel to let us know in advance so we can direct you on where to park. OWI shall not assume liability or responsibility for any vehicle, occupants, or contents while operated or parked on the motel property.  Visitors of motel guests parking in the OWI parking lot must visit the Front Desk and speak with an OWI staff member to get a parking pass. Vehicles parked in the OWI parking lot that cannot be associated with our guests will be towed at the owner’s expense.  If a vehicle is left in the motel parking lot after the guest has departed without the written consent of the motel, the motel reserves the right to have the vehicle towed at the owner’s expense. No vehicle repairs are allowed on motel premises. 

12. WiFi and Internet Access OWI offers free Wi-Fi Internet access to our guests. OWI cannot be held responsible for the non-availability of the Internet network, the inability of accessing the Internet, external intrusion, computer viruses, or non-authorized online transactions made using our Wi-Fi Internet access. As a condition of your use of our free WiFi Internet access, you warrant to OWI that you will not use our WiFi Internet access for any purpose that is unlawful or prohibited by these terms, conditions, and notices. OWI will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone engaging in unlawful activities using our WiFi Internet access. 

13. Use of the oldwatersinn.com website


AUTHORIZED USE OF THE WEBSITE: The documents, data, information, and other materials (collectively the "Material(s)") contained on the OWI website are provided by Old Waters Inn at Wedowee exclusively for use by prospective and confirmed guests to inquire about or make travel reservations and related services and for no other purpose (collectively, “Authorized Users”). By accessing, viewing, and/or using the OWI website or any of its services, functions, materials, or contents (including to transmit, cache, or store information), you shall be deemed to have read and agreed to each and all of the terms without modification. If you do not agree to these Terms, you may not use the OWI website, including without limitation to make a reservation or download any materials from it.


WEBSITE ERRORS AND OMISSIONS: OWI makes every effort to ensure that all the information that appears on its website is accurate. However, no warranty, expressed or implied, is given that the information provided on this website is error-free. OWI does not accept liability for any errors and/or omissions and reserves the right to change the information published at any time and without notice. If you feel that information at this website is in error or that relevant information has been omitted from the website, please submit your comments to webmaster@oldwatersinn.com for review and appropriate corrective action.


LINKS TO OTHER SITES: The OWI website may contain links to websites that are maintained and/or controlled by third parties. These links are provided as a courtesy to our guests who maybe interested in tourism and dining options in the Wedowee, AL area. We make no representations or warranties with respect to such third-party websites.


COPYRIGHT AND TRADEMARK NOTICES: All contents of the OWI website are the copyrighted property of Old Waters Inn at Wedowee, or its parents, subsidiaries, affiliates, as applicable, or we have received permission to publish content from the owner of the digital content. All contents of the OWI website are protected by United States and international copyright laws. We respect the copyright rights of others and have adopted and implemented a policy that provides for (a) the removal of improper content from this website under appropriate circumstances, and (b) the suspension or termination of users, account holders or subscribers who repeatedly infringe the copyright rights of others. If you are a copyright owner and you believe your work has been copied in a way that constitutes copyright infringement, please contact the OWI webmaster at webmaster@oldwatersinn.com for review of your claim and assistance with removal of the content in question. 

14. Pet Policy Pets are not allowed in OWI motel rooms. Guests who are found to have pets in their room(s) will be assessed a cleaning fee of up to $300.00. 

15. Smoking Policy OWI is a smoke-free facility and any smoking inside of the motel of any kind is prohibited. This includes, but not limited to the smoking of tobacco, marijuana, illegal drugs, e-cigarettes, vape pens, vaping cartridges containing nicotine, hookahs, incense, cigars, candle burning, diffusing oils or other strong smelling plant-based essential oils, any other synthetic products, or cooking in rooms. Due to the nature of these materials, it is difficult to remove these odors from the air, carpet, walls and furniture. Guests who are found to have smoked in their room(s) will be assessed a cleaning fee of up to $500.00 and will be asked to vacate their motel room immediately. 

16. Dispute Resolution/Problems “Claim(s)” mean and include any claims or disputes between Guests and OWI arising out of or related to a stay at our motel, our Terms and Conditions, any services we may have provided, or your use of or access to the OWI website. This Contract, including the enforcement and interpretation of this dispute resolution provision, and any Claims that might arise between you and OWI shall be exclusively governed by and construed in accordance with the Federal Arbitration Act, federal arbitration law, and, if not inconsistent, the state laws of Alabama, exclusive of choice of law rules. OWI is committed to customer satisfaction and will make a good-faith effort to try to resolve any Claims presented by Guests. Guest agrees that they will first try to resolve any Claim(s) by reaching out to OWI management and asking for resolution prior to any sort of escalation with third parties such as a credit card company or legal counsel.  In the unlikely event that OWI and Guest cannot come to an agreeable resolution regarding any sort of dispute, you agree that the dispute will be resolved exclusively through final and binding arbitration. Arbitration shall be resolved by one arbitrator; there is no court case, judge, or jury. The single arbitrator will resolve any claims between Guest and OWI, and the arbitrator's award regarding any dispute or claims shall be final and binding. The arbitration may be conducted by telephone, videoconference, written submissions, or in person where you live or at another location mutually agreeable to the parties. 

17. Use of Personal Information 


INFORMATION WE COLLECT: OWI collects information that you give us during the reservation and check-in process. For example, we collect information from you when you make a booking through our website or check-in at our motel. Information collected during the course of the reservation and during your stay may include: Your name, email address, home and business address, phone number, nationality and payment card information. In addition, it may include information such as dates of your stay, room preferences, and any specific requests made during your stay.


INFORMATION WE GET FROM YOUR USE OF OUR WEBSITE: OWI collects information from you when you browse the Old Waters Inn website or use our free wireless internet services. In these instances, information such as your country information, internet protocol (“IP”) address, media access control ("MAC") address and other characteristics about your system or device may be automatically collected. This information may be collected for functional purposes as well as to improve your experience when using these services. This information may also be used for aggregated trend and statistical analysis, and for showing you more relevant advertisements and messages. Site usage may also provide us with other information including, without limitation, domain server, type of computer, and type of web browser and other relevant information about your online experience and use of the OWI website.


INFORMATION STORED ON YOUR COMPUTER (“COOKIES”): When you visit the OWI website, OWI may store some information on your computer. This information will be in the form of a "cookie" or similar file and can help us maintain and improve the website. A "cookie" is a small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card, recording such things as Internet addresses, passwords, and preferences. When you visit the website again, the cookie allows that site to recognize your browser. It cannot be executed as code or deliver viruses. With most Internet browsers, you can erase "cookies" from your computer hard drive, block all "cookies," or receive a warning before a "cookie" is stored. Please refer to your browser instructions to learn more about these functions.


HOW WE USE THIS INFORMATION: We use the information collected from you primarily to fulfill your motel reservation. Prior to your stay, this may include sending you pre-stay communications. Following your stay, we may also send you post-stay communications and satisfaction surveys to get feedback on your experience at our motel.


WHO WE SHARE YOUR INFORMATION WITH: Aside from the purposes described above, we do not share your stay information with any other third parties unless we have your consent or under special circumstances, such as: (A) When we believe in good faith that the disclosure is required by law or to protect the safety of motel guests, employees, the public or motel property, (B) When disclosure is required to comply with a judicial proceeding, court order, subpoena, warrant or legal process, and (C) In the event of a merger, asset sale, or other related transaction.  There may be other times when we collect and use personal information, for example if you choose to participate in one of our competitions or sweepstakes, or sign up to receive our newsletters or other special offers and promotions. In these instances, we will collect information from you for running and administering the respective competition, sweepstakes or service that you have elected to participate in. The information collected may include personal details such as your name, address, and contact information, as well as certain demographic information. In each case, we will collect, use and secure your information in a manner consistent with the general principles set out in this policy.


SOCIAL MEDIA: We may use various social media features such as the Facebook “Like” button on our websites and mobile applications. Certain information may be shared or otherwise provided to us through your use of these features in conjunction with our services and programs. Subject to your account and privacy settings, we may also be able to see information that you post when using these social media platforms whether or not you are using one of our services. In some instances, depending on the circumstances, we may contact you on these social media platforms. The information you post on social media sites as well as the controls surrounding these disclosures are governed by the respective policies of these third parties.


HOW WE SECURE YOUR INFORMATION: We are committed to protecting the confidentiality and security of the information that you provide to us. To do this, technical, physical and organizational security measures are put in place to protect against any unauthorized access, disclosure, damage or loss of your information. The collection, transmission and storage of information can never be guaranteed to be completely secure. Even so, we take steps to ensure that appropriate security safeguards are in place to protect your information.


MANAGING YOUR INFORMATION: In the event any information that you provide to us is inaccurate and changes need to be made or you would like certain information deleted, your information can be updated by contacting a Front Desk Associate at the OWI motel via email at frontdesk@oldwatersinn.com or by phone at 256-357-1081. Please note that in some instances it may not be possible to delete certain pieces of your information.


SPECIAL INFORMATION FOR CALIFORNIA CONSUMERS: California residents who have stayed with us may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us through one of the methods listed under the “How to contact us” section below. Please allow up to thirty (30) days for a response. 

18. Guest Liability and Responsibilities Guests agree that the property will not be used for purposes that are illegal, unsafe, or disruptive and/or annoying to other guests. Guests acknowledge that they will be respectful of other OWI guests and neighbors. They agree to obey all posted signs and property rules. Guests who observe other guests engaging in any of the activities described above are encouraged to report the situation to the OWI Front Desk or call 256-357-1081 for assistance. Guests also acknowledge that they are using the property for the purpose of short-term rental in "as is" condition, at their own risk. Guests will not relocate, disconnect, or remove furniture, fixtures, or appliances within the motel rooms or on motel property without the permission and assistance of OWI staff. Guests will be held liable for any damage howsoever caused (whether by the deliberate, negligent, or reckless act) to the room(s), motel’s premises or property caused by Guests or any person in your party while either staying or visiting the room occupant at the motel during their stay.  If OWI receives a complaint of a disturbance or nuisance at the premises, our staff will contact the Guest and request that they immediately discontinue the disturbance or nuisance. If the guest or anyone in the Guest’s party causes a disturbance or nuisance at the premises, such that local law enforcement is contacted, then the guest may be required to vacate the premises IMMEDIATELY, at the discretion of OWI motel management. Any removal will result in a forfeiture of the entire amount of the reservation, and loss of use of the property and room. Guests hereby acknowledge that they have been informed that OWI is NOT a child-proofed property. It is the Guest's responsibility to monitor the activities of all minor children in their care. Guests agree to be held liable for actions of his/her guests, whether they be registered or unregistered guests, at all times, and by doing so to "hold harmless" OWI, its owners, managers, representatives and employees from any and all claims arising from their guest's use of the property.  OWI reserves the right to retain Guest’s credit card and/or debit card details as they are presented at registration and to charge or debit the card such amounts as it shall in its sole discretion deem necessary to compensate or make good the cost or expenses incurred or suffered by OWI as a result of repairing any damages as described above. Should this damage come to light after the guest has departed, OWI reserves the right and you hereby authorize us to charge your credit or debit card for any damage incurred to your room or the motel property during your stay, including and without limitation for all property damage, missing or damaged items, smoking fees, and cleaning fees. 

19. OWI Responsibilities and Limited Liability 


RESPONSIBILITIES: OWI staff cleans each room prior to check-in, providing fresh linens, towels, soap, shampoo, lotion, pillows, blankets, trash bags and tissue prior to Guest’s arrival. Daily maid service is provided and will replenish these items as needed. If Guests do not want daily maid service, they can place a “Do Not Disturb” door sign on the exterior of the door or notify the Front Desk. Guests requiring additional maid services or additional services may visit the Front Desk or call 256-357-1081 for assistance. 


LIMITATION OF LIABILITY: In no event shall OWI be liable for any special, indirect or consequential damages or any damages whatsoever, including loss of profits or data, whether in an action in contract or tort, arising out of the use or performance of our website, or the performance or non-performance by OWI motel or any third party providers of products or services related to any stay at the OWI motel. This limitation of liability shall apply regardless whether the claim asserted is based on contract, negligence, or any other theory of recovery, even if the OWI motel has been advised of the possibility of such damages.


THEFT OR DAMAGE TO GUEST PERSONAL PROPERTY: OWI and its owners, managers, representatives and employees are not responsible in any way for theft or damage that may occur on or to your personal property during your stay. This applies to any theft or damage that may occur to your personal property stored in your motel room as well as any vehicle parked in the OWI parking lot. 


INDEMNIFICATION: Guests agree to indemnify, hold harmless and defend the OWI motel, its members, owners, directors, officers, employees, attorneys, and agents from and against any action, cause, claim, damage, debt, demand or liability, including reasonable costs and attorney's fees, asserted by any person, arising out of or relating to loss, damage, illness, injury or death resulting from the use of the property, its fixtures and contents. 

20. Force Majeure OWI will not be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond the control of OWI. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, earthquake, volcanic activity, ash clouds, tsunamis, fire, floods, and explosions. 

21. Severance If any provision of the OWI Terms and Conditions are found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from the booking agreement between Guest and OWI, and will not affect the validity and enforceability of any remaining provisions within the OWI Terms and Conditions.
